This Privacy Policy explains how EM Fitness, doing business as EM Wellness ("EM Wellness," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you use our website, Pilates and fitness application, online equipment store, membership and loyalty features, customer support, returns tools, and related services (together, the "Services").

  • We use personal information to provide Pilates and fitness features, manage accounts, fulfil equipment orders, operate EM Club benefits, respond to support and returns requests, and improve and secure the Services.
  • Fitness goals, workout history, and progress information may be sensitive in some places. We use this information only for the purposes described here and do not intend the Services to store medical records.
  • When you buy equipment, we also process order, delivery, transaction, and returns information and share necessary details with payment and delivery providers.
  • We do not sell personal information for money. We do not use personal information for cross-context behavioural advertising unless we first update this Policy and provide any choices required by law.

1.Who we are and how to contact us

EM Fitness is the business responsible for the personal information described in this Policy. For data-protection purposes, we act as the controller where applicable.

2.Scope of this Policy

This Policy applies to the Services and to personal information we receive through them. It does not govern third-party websites, app stores, social networks, payment services, delivery providers, or messaging platforms that have their own privacy notices. If you follow a third-party link or use a third-party service, review that provider's privacy terms.

3.Information we collect

3.1 Information you provide

  • Account and identity information, such as your name, email address, phone number, login method, verification status, and account preferences. Authentication credentials and verification codes are processed to create and secure your account.
  • Pilates and fitness information, such as goals, experience level, selected programmes, completed sessions, activity history, progress, achievements, saved content, workout preferences, and other information you choose to enter. Depending on the data, this may reveal information about your health or wellbeing.
  • Order and delivery information, such as the equipment you buy, product options (including size, colour, and quantity), order number, name, email, phone number, billing and delivery address, country, postal code, order value, discounts, loyalty points, delivery status, and returns or exchange details.
  • Payment and transaction information. Payments are processed by credit cards, Apple Pay, Google Pay, and PayPal. We receive information needed to confirm and administer a transaction, such as payment status, payment method, transaction reference, amount, and limited payment details. We do not intend to store full payment-card numbers in the EM Wellness application database.
  • EM Club and marketing information, such as your name, email address, phone number, birthday, membership tier, points, discount codes, communication preferences, and promotion history.
  • Communications, support, and returns information, including messages you send to us, information entered into a shopping or returns assistant, order-search details, feedback, and communications through email, WhatsApp, or other channels.
  • User-generated content, if enabled, such as ratings, reviews, titles, comments, uploaded images, display name, and fit or product feedback.

3.2 Information collected automatically

  • Device and connection data, such as IP address, browser type, operating system, device type, language, approximate location derived from IP, and network or error information.
  • Usage and analytics data, such as pages viewed, features used, links selected, session identifiers, referring page, timestamps, and interactions with the Services.
  • Cookies and similar technologies, including local or session storage used for authentication, cart continuity, language or interface preferences, analytics session identifiers, and remembering whether a promotional message has been shown.

3.3 Information from third parties

  • Sign-in providers. If you sign in with Google or another supported provider, we may receive your name, email address, profile identifier, and other information you authorise that provider to share.
  • Payment, fraud-prevention, delivery, and returns providers, which may give us transaction confirmations, risk signals, delivery updates, and information needed to handle an order or return.
  • Service providers and integrations you choose to use with the Services, subject to their terms and your settings.

4.How we use personal information

  • Provide and operate the Services, including account access, Pilates programmes, workout content, saved preferences, progress features, and personalised recommendations based on the information you choose to provide.
  • Process and fulfill equipment orders; confirm payments; calculate totals, discounts, and loyalty points; arrange delivery; provide order updates; and manage returns, exchanges, refunds, and warranties.
  • Operate EM Club, including membership levels, points, discount codes, birthday benefits, and other member benefits.
  • Respond to questions, provide customer support, operate shopping and returns assistants, and communicate about accounts, orders, security, service changes, and support requests.
  • Send newsletters, promotions, birthday messages, product updates, and other marketing where you have consented or where otherwise permitted by law.
  • Measure and improve performance, usability, content, products, Pilates programmes, and customer experience; conduct analytics; and develop new features.
  • Protect the Services and users, verify identity, prevent fraud and abuse, troubleshoot problems, enforce our terms, and maintain records needed for security and dispute resolution.
  • Comply with legal, tax, accounting, consumer-protection, regulatory, and law-enforcement obligations and establish, exercise, or defend legal claims.

5.Legal bases where applicable

Where laws such as the GDPR or UK GDPR require a legal basis, we rely on one or more of the following:

  • Contract: processing needed to create an account, provide app features you request, complete purchases, deliver equipment, and manage returns or membership benefits.
  • Consent: for optional marketing, non-essential cookies where required, and certain sensitive Pilates or wellness information where explicit consent is required. You may withdraw consent at any time, without affecting earlier lawful processing.
  • Legitimate interests: operating, improving, securing, and understanding the Services; preventing fraud; supporting customers; and managing our business, provided those interests are not overridden by your rights.
  • Legal obligation: keeping required tax and transaction records, responding to valid legal requests, and complying with applicable law.

6.Pilates, fitness, and potentially sensitive information

Pilates goals, workout history, progress, performance, body measurements, injuries, accessibility needs, or similar information can be sensitive and may be treated as health-related information under some laws. We will only collect fields that are reasonably needed for an available feature and will seek additional consent where required.

The Services are for general fitness and wellness and are not intended to receive medical records, diagnoses, treatment plans, insurance information, or other protected health information. Do not include such information in free-text forms, reviews, support messages, WhatsApp messages, or AI-assisted chats. If a feature later requires medical or highly sensitive information, we will provide an additional notice and obtain any consent required before collection.

7.AI-assisted features

The Services may include AI-assisted shopping, product-recommendation, or returns features. When you use one of these features, your prompt, relevant conversation context, and information needed to answer your request may be sent to EM Wellness's platform and AI service providers. We use this information to generate a response, maintain the conversation, prevent misuse, and improve support.

Do not enter payment-card numbers, passwords, government identifiers, medical records, or unnecessary sensitive personal information into an AI-assisted feature. AI responses may be incomplete or inaccurate; do not rely on them for medical advice, diagnosis, treatment, or emergency support.

8.When we disclose personal information

We may disclose personal information to the following categories of recipients only as reasonably necessary:

  • Platform, hosting, database, analytics, security, media-hosting, email, and technical service providers. The Services are built and hosted using Base44, operated by Wix.com Ltd., and Base44 processes application-user data for us under its data-processing terms.
  • Payment and fraud-prevention providers, to authorise payments, prevent fraud, process refunds, and administer disputes.
  • Delivery, fulfilment, warehousing, and returns partners, to ship equipment, provide delivery updates, and handle returns or exchanges.
  • Authentication and account providers, such as Google, when you choose their sign-in service.
  • Communications providers and channels, such as email delivery services and WhatsApp, when needed to send requested or consented communications.
  • AI providers when you use an AI-assisted feature, subject to contractual and technical controls available to us.
  • Professional advisers, insurers, auditors, and authorities when reasonably necessary to protect rights, comply with law, or establish, exercise, or defend legal claims.
  • A buyer, investor, lender, or successor in connection with a proposed or completed merger, financing, restructuring, sale, or transfer of all or part of our business, subject to appropriate safeguards.

We do not sell or rent personal information for money.

9.Cookies, local storage, and analytics

We and our providers use cookies, browser storage, pixels, logs, and similar technologies to keep you signed in, maintain your cart, remember preferences, protect the Services, understand use, and improve performance. Some are necessary for the Services to function. Analytics or marketing technologies will be used with consent where consent is legally required.

You can control many cookies through your browser and, where available, our consent controls. Blocking essential storage may prevent account, cart, checkout, or preference features from working correctly.

10.Marketing communications

If you subscribe, join EM Club, or otherwise consent, we may send promotions by email, SMS, WhatsApp, or another channel you select. You can opt out using the unsubscribe method in a message or by contacting Support@em-wellness.com. We may retain a limited suppression record so that we can honour your choice. Opting out of marketing does not stop necessary account, order, delivery, returns, security, or legal communications.

11.International data transfers

We and our service providers may process personal information in Israel, the United States, and other countries that may not provide the same data-protection rules as your country. Where required, we use recognised transfer mechanisms and contractual safeguards, such as adequacy decisions or standard contractual clauses, and apply supplementary measures appropriate to the transfer.

12.How long we keep information

We keep personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing the Services, maintaining security, resolving disputes, enforcing agreements, and meeting legal, tax, accounting, and consumer-protection obligations. Retention depends on the type of information and the reason it was collected.

  • Account and Pilates-app data is generally kept while your account is active and for a reasonable period after deletion or inactivity to complete requests, maintain backups, prevent fraud, and resolve disputes.
  • Order, payment-confirmation, delivery, refund, and tax records are kept for the period required by applicable commercial, tax, accounting, and consumer-protection laws.
  • Marketing information is kept until you opt out or the information is no longer useful, plus a limited suppression record where needed to respect your choice.
  • Support, returns, and AI-assistant conversations are kept for a reasonable period based on the request, safety and quality needs, and any related transaction or dispute.
  • Analytics and technical logs are kept according to operational and provider retention settings, then deleted or de-identified where reasonably possible.

13.Security

We use reasonable administrative, technical, and organisational measures designed to protect personal information, such as access controls, authentication, encrypted transmission, provider security controls, logging, and staff or contractor access restrictions. No website, application, transmission, or storage system is completely secure, so we cannot guarantee absolute security. Use a unique password where a password is offered, protect verification codes, and tell us promptly if you suspect unauthorised access.

14.Your privacy rights

Depending on where you live and subject to legal exceptions, you may have the right to:

  • Ask whether we process your personal information and request access to it.
  • Ask us to correct inaccurate or incomplete personal information.
  • Ask us to delete personal information or close your account.
  • Object to or restrict certain processing, including direct marketing.
  • Withdraw consent at any time where processing is based on consent.
  • Receive certain information in a portable format where applicable.
  • Complain to the privacy or data-protection authority in your country. In Israel, this may include the Privacy Protection Authority; in the EEA or UK, you may contact your local supervisory authority.

To make a request, email Support@em-wellness.com and describe what you want us to do. We may ask for information needed to verify your identity and protect your account. We will respond within the period required by applicable law. Rights are not absolute, and we may retain or refuse information where the law permits or requires it. You may also use available account settings to update information or request account deletion.

15.Children and minimum age

The Services are not directed to children under 16, and we do not knowingly collect their personal information without any consent or authorisation required by law. If you believe a child has provided personal information contrary to this section, contact Support@em-wellness.com so that we can investigate and take appropriate action.

16.Third-party services and public content

The Services may link to app stores, payment services, social networks, WhatsApp, delivery tracking, or other third-party services. Their privacy practices are governed by their own notices. Information you publish in a public review, rating, or community feature may be visible to others, so do not include information you want to keep private.

17.Changes to this Policy

We may update this Policy when our Services, providers, or legal obligations change. We will post the updated version and change the "Last updated" date. If a change materially affects how we use personal information, we will provide additional notice or seek consent where required.
